Description of Our Activities - Our Current Efforts

 

Our organization's current activities include the following.

 

1.   Upholding Pa.'s abortion funding restrictions.

 

2.   Defeating for Retention the three pro-abortion Democrat incumbent Pa. Supreme Court Justices in the November 4, 2025 General Election.

 

3.   Advancing the mitigation of the Pa. abortion industry's routine cover-up of the sexual abuse of minors.

 

4.   Assisting local pro-life activists and pregnancy resource centers with legal challenges.

 

Other Consequences of the November 5, 2024 General Election

 

Pa. proved decisive to President Trump's victory in this Election.  Except for his verbal statements in support of federal funding for in-vitro fertilization, his second term is currently proving very beneficial to the success of the pro-life movement's national public policy efforts.  The one-year defunding of Planned Parenthood (PP) in the "Big Beautiful Bill" (BBB) provides a good example of this benefit.

 

While the Pa. pro-life movement was only a part of President Trump's victory, the Pa. pro-life movement's efforts proved decisive for the election of Pa.'s U.S. Senator Dave McCormick and Pa. Attorney General (AG) Dave Sunday.  Sen. McCormick has so far compiled a consistently pro-life record by supporting the BBB and the defunding of PP.  However, AG Sunday's current record is mixed and is the focus of many of our current efforts.

 

1. Upholding Pennsylvania's Abortion Funding Restrictions

 

Since taking effect in 1985, Pa.'s Medicaid abortion funding restrictions continue to annually save at least 5,000 expectant mothers and their children from abortion.  However, in January 2019, because of a new Democrat majority on the Pa. Supreme Court (PSC), 16 Pa. abortion chambers filed a lawsuit seeking the PSC invent a "right to abortion" in the Pa. Constitution and void Pa.'s Medicaid abortion funding restrictions.  Pa.'s pro-abortion Gov. Tom Wolf and AG Josh Shapiro refused to defend these restrictions.

 

This case has proceeded quite slowly.  In May 2023, the Pa. Commonwealth Court declined to invent this right, upheld these abortion funding restrictions, and allowed pro-life attorneys for the Republican Pa. House and Senate to defend these restrictions.  (Attorneys for our organization provided much of the legal input for the defense.)  The Pa. abortion industry appealed this decision to the PSC.

 

In January 2024, in a mixed and ominous decision, the PSC still declined to invent this right but remanded this case back to Pa. Commonwealth Court under new pro-abortion guidelines.  The PSC also removed the Pa. House and Senate Attorneys from defending these restrictions.

 

Some good news in this case occurred in March 2025, when AG Sunday, after intense advocacy from our organization, decided to defend these restrictions.  Our organization's attorneys are again providing much assistance to AG Sunday in this case, on which the PSC is not likely to rule until late 2026.

 

2. Three Pro-Abortion Democrat Pennsylvania Supreme Court Justices Face a Retention Vote in the November 4, 2025 General Election

 

An opportunity to achieve some good news in this case exists by defeating these Justices.  For our organization's initial flyer which urges a No Vote on their Retentions, see below or click here.  Our organization will be working with other Pa. pro-life and secular organizations to effect an extensive distribution of this or a similar flyer, as well as intense efforts to generate a large turnout of Republican voters for this Election.

 

3. We Are Currently Urging Attorney General Dave Sunday to Mitigate the Pennsylvania Abortion Industry's Routine Cover-Up of the Sexual Abuse of Minors

 

During his 2024 candidacy, AG Sunday emphasized his record, as York County District Attorney, in resisting the sex trafficking of minors.  The Pa. abortion industry enables this trafficking by committing abortions on minor girls without notifying law enforcement or Child Protective Services.  In Pa., the age of legal consent for sexual intercourse is 16.  So, pregnancy in a girl 13-15 could be statutory rape if the male is four or more years older than the girl.  Pa. law also states that pregnancy in a girl 12 or younger is ipso facto evidence that this child has been sexually assaulted.

 

The annual Pa. Department of Health (DOH) Abortion Statistics Report, by Age and by County, only lists the number of abortions committed on girls 15 or younger.  The DOH has implemented a policy that it will only reveal the 12 or under statistics in response to a request from law enforcement officials.  Prior Republican AGs, such as Jerry Pappert and Tom Corbett, did request and receive this information.

 

However, so far, AG Sunday has proven unwilling to make this request of the DOH.  His assistant does not provide a reason and deflects by responding to a distortion of our request, viz., that we are seeking the identities of minor children on whom an abortion has been committed.

 

For now, our organization's leaders and attorneys are leading a behind-the-scenes efforts to persuade AG Sunday to make this request.  (Such efforts were required to persuade AG Sunday to defend Pa.'s Medicaid abortion funding restrictions.)  These efforts include generating appeals from pro-life Members of the Pa. House and Senate.  We are prepared to make public efforts if AG Sunday continues to refuse to make this request of the DOH.

 

The availability of this information is necessary for advancing the efforts to determine whether the personnel at these abortion chambers, where these abortions were committed on girls 12 or younger, complied with Pa. sexual abuse reporting laws.

 

Under Pa.'s 2011 abortion facility regulation law (enacted after the 2010 revelations regarding Philadelphia abortionist Kermit Gosnell), failure to do so can result in a temporary or permanent loss of their DOH license to commit abortions.

 

4. Local Actions

 

Given the often-demonstrated expertise of our organization's attorneys, prior local police or County District Attorney harassment of sidewalk counseling efforts in our area has ceased.  However, the security guard at a Center City Philadelphia abortion chamber recently pepper-sprayed the face of highly faithful and successful sidewalk counselor, Tony Farnan.  Our attorneys are assisting him with a private criminal complaint against this security guard.

 

In a continuing effort to reach local abortion-vulnerable women prior to their arrival at an abortion chamber, local pregnancy resource centers have begun using mobile ultrasound vans in various portions of Philadelphia and its suburbs.  The use of these vans does require meeting some licensure requirements with which our attorneys are assisting these centers.
